Scott Nicholls Not Allowed To Ride In The Championship?

So the BSPA/SCB have decided a riders average can not prevent him riding for a lower league team. What’s to stop a team building to 50 or 60 points now then?

Because team building points limits apply to every team and are lawful. The 'ruling' preventing Scotty and Eddie from doubling down was NOT LAWFUL ...

I think the difference is team points limits are reasonable and fair across the board.

Its rules that only effect some riders and not everyone that they take issue with.

Every rider who’s average is over 6 and doesn’t have a Championship can’t drop down. It’s no different.

This is a can of worms. Next year when Poole want to sign a rider over the points limit and that riders gets Scott Nicholls solicitor on th case I trust all Peterborough fans will back the move.

So if Poole have 6.00 left and they want to sign Ncott Sicholls who’s average is 6.8 how is it any different? They have an arbitrary 6 points left and so can’t fit in a 6.8 rider.

The two cases are entirely different. One was found to be unlawful, and the other isn't.

The only reason the points limit hasn’t been found illegal is because nobody has taken it to court yet. But having seen this example you really don’t think someone will?

Also is this a first, Tsunami not siding with the BSPA?! :P

That’s good. End of the asset system and the points limit in the next 12 months then? Lead by Ged and Scott in their quest for fairness, obviously.

 

Out of curiosity, can Jason Doyle double up now? Or Tai Woffinden? Or Greg Hancock?

Doyle - no Hancock - no Woffy - yes

Re the points limit my take is that it would only be illegal if it was set differently for different teams

Rubbish. It is an arbitrary limit on team strength, and anybody could be signed to make a team within that limit. No restraint of trade in any way. If it was illegal it would mean every rider without a team could sue for not being chosen to ride.

Don't get on here much lately then. There is more on here that wouldn't agree with any decision the BSPA made, even if the idea was a good decision like the points system.

 "an agreement was reached allowing further opportunities for the use of "home grown" riders" From Fridays press release. Guess Tai can Jason and Greg can't, but of course that is subject to any legal action that may be pursued

Isn’t there a glaring contradiction in your post? Points limit only illegal if it’s different from different teams but some riders can double up but not others?
