Maybe I am missing some peculiarity with speedway or sport in general but how can they do this?

How can you deny the opportunity to go an earn a living in another country when you cant offer the same opportunities in your own country? I could understand how they could tell Emil if you ride in Poland you will be refused the opportunity to ride in Russia. I can also understand how they could say to Emil you cant leave to go to Poland because our borders are closed....which i know is not a fact as Im currently sat with 3 Russians who have travelled here to work in the North Sea.

The same goes for the Swedish, Danish and British authorities thinking of preventing riders from going to ride in Poland, how can they do this? Surely they can only give them the choice, its either Poland or us. Im not certain of Dan Bewley's current stance but for example if the BSPA/SCB or Belle Vue tried to ban him from riding in Poland but cant guarantee him any rides in the UK surely they dont have a leg to stand on

He`s signed a contract to ride for Balakovo in the Russian league- if he hadn`t he would be ok(like Woffinden) if he wanted to be in Poland for all that time !

If Poland relax there quarantine and travel stipulations eventually it will enable more riders to ride there.

Yes I understand that, but there is no guarantee at this moment the Russian league will go ahead, unless that contract with Balakov guarantees him payment irrespective of actually riding??

As for being in Poland all that time?? Its only 5 months, May 8th till last meeting being the 11th September...ok there could be play offs but still first week in October only takes it to a total of 5 months and your still free to move around as you wish within the country and for all anyone knows the borders could open up mid july etc.....potentially 130K for 5 months away....its hardly difficult

Sometimes family life is more important, and don`t forget Emil has shown previously when he refused to ride in the GP`s that he is his own man !!

Yes i know and a couple of weeks ago Emil said he was unlikely to ride in Poland anyway, but my question was how can each countries governing body ban you from doing something when they cannot guarantee you can do that job in your own country...Emil/Russia was just an example.

When you take your license from any FMN (your chosen federation, usually the country you have a passport from) U tick the box that says ”I follow the rules” and nowadays there is also a sidenote that says your available to ride for your country and if WADA catches you, you are responsible for the penalties and pay for them.

So if you make yourself unavailable, they can therefor revoke your starting permit. Or like FLindgren badmouthed a svemo person a couple of years ago, they took his starting permit for a month...

It’s not all that complicated. And it would work better if PZM or Ekstraliga would follow the system.

Sure.     Collective strength may see the pay scale raised a little bit.     Why accept a first offer.

Further Drabik article- Google translation

Slag. POLADA will not suspend Drabik. Wait for the judgment of the Court. Will the player go in the league?
Max Drabik's application for retrospective TEU rejected. The speedway patron wants the case to be dealt with by the Arbitration Court at the Polish Olympic Committee. If this does not meet before June 12, then Maksym Drabik will go to the inauguration of the league.

Slag. Drabik's application for retrospective TEU rejected. His patron wants to go to the Tribunal at the Polish Olympic Committee
POLADA rejected Maxim Drabik's request for retrospective TEU, but now the attorney of the speedway Łukasz Klimczyk wants the same application to be considered by the Arbitration Court by the Polish Olympic Committee. This may delay the case in time, because in the past the Tribunal was able to deal with the case six months from the receipt of documents. For Drabik, but above all Betard Sparta Wrocław, this does not necessarily have to be a bad solution. Especially because of the POLADA position.
We spoke to the anti-doping director Michał Rynkowski if he intends to do anything about the Drabik case until the court has considered the case. The answer was unambiguous: there would be no action, and certainly there would be no suspension of the speedway until the application was considered. So if the Tribunal does not meet before June 12, then the Sparta speedway will take part in the match inaugurating the PGE Ekstraliga season.

Drabik will run in the league until the court has considered the case. If this gathers in half a year, then the speedway will complete the current competition and worry about suspension before the next. POLADA does not intend to make any moves, because it must also assume such a variant that the Tribunal may make a decision favorable to the speedway rider. If this happened and the player was suspended in absentia, both his club and himself could claim damages.

If the Tribunal is slow, Sparta will not have to worry about composition. The question is, how will Drabik be found in such a situation? At the back of his head would be the thought that he could be hung at any time. Will it translate into its results and how? This cannot be predicted today

Guess they have to say he is innocent until proven guilty. But how does it work if he is found guilty with his points? Can't remember, but didn't they want someone elses points deducted? Dudek maybe. Can't remember how that worked out....

From memory I’d say you’re banned to ride if an A test is positive. Then B either sets you free or nails you.

Basically Drabik was caught in a test and himself said it was because he had a treatment that was considered a doping offense.

And they gonna let him ride?

The Polish federation doing as they want again giving the middle finger to the rest of the speedway world. I remember all the buzz when Darcy was over the limit but was allowed to continue racing until several weeks later causing arguments about team points and averages.

He has been proven guilty already and should be suspende because otherwise every rider will do the same and claim TEU (get away with doping).

Doesn't matter though. DMU like Svemo and the Russians have blocked their riders from riding in Poland.

New Sportowefakty article today on the Drabik situation- Google translation

Slag. The Arbitration Tribunal at the Polish Olympic Committee on the Drabik case. There is a chance that he will consider it before June 12
- If we get an application next week and we know that the case is urgent, we will do everything to resolve the problem before the start of the games - says about the case of Drabik, Roman Troicka-Sosińska, spokesman of the Tribunal at the Polish Olympic Committee.

POLADA rejected the application of the plenipotentiary Maxim Drabik to grant the player a retrospective TEU to accept the drip before last year's PGE Ekstraliga final. Advocate Łukasz Klimczyk has already announced the submission of an application to the Arbitration Court at the Polish Olympic Committee. Now there he wants to apply for TEU, because having them, he closes the case. TEU would justify the drip, so Drabik would be clean by law and could focus on driving.
The Arbitration Tribunal has not yet received a letter in the Drabik case, but Ms Romana Troicka-Sosińska, the institution's spokesperson, announces that she will try to hear the case quickly. - If we get an application next week and we know that the matter is urgent, we will do everything to resolve the problem before the start of the games - says Troicka-Sosińska.

- The lawyer representing the player has already been to the Tribunal and knows the procedure, so he will know how to speed things up - continues Troicka-Sosińska. - On our part it looks like we accept the application, then pay the fee, and finally the secretary appoints the composition. The topic is media, so we know that it would be good to issue a judgment by June 12. It is a little over a month, so there is a good chance that we will make it within this period.

We hear from the spokesperson that if the Arbitration Tribunal's decision is unfavorable, then lawyer Klimczyk may lodge a complaint with the Supreme Court. Based on the knowledge from the last auditions before POLADA, it can be said with great probability that it could end this way. Our information shows that it is not, as defense lawyer Drabik says, that the only reason for rejecting an application for TUE by an anti-doping drug was its late submission.

Of course, submitting an application a few months after the final is the main reason for its rejection. There were, however, different. First, there were doubts about the testimony given by the athlete's doctor. Secondly, it has not been shown that all authorized means were used before the drip. Finally, Drabik himself did not indicate the objective circumstances that prevented him from applying for retro-TEU earlier.

Drabik explained that the club doctor Betard Sparty Wroclaw told him that taking half a liter of drip was not prohibited, that he could do it. This, however, is a poor translation, given that he had already heard that it was against the law at the check he had admitted to having the IV drip. And if only on this basis, he should have submitted the application immediately.
