Isn't his point that if he rides in Poland but doesn't return for Birmingham then he'll be deemed to be withholding services?

Sometimes it's better to say nothing or say he'll be there if treatment permits

There may of course be a relaxation in planning laws at some point by a future government if BE want to/can play the long game
